Terms of Service

1. Acceptance of Terms

By accessing or using PhotoProof Labs, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Service Description

PhotoProof Labs provides analysis tools that estimate whether images, videos or text may have been created or modified using artificial intelligence.

The service provides probabilistic results, confidence scores and informational reports only.

New account registration is currently unavailable for users located in the Russian Federation. This restriction applies only to the creation of new accounts. Existing accounts are not affected and can continue signing in as usual.

Unified analysis report

PhotoProof Labs generates a unified report that may include an AI-generation probability estimate, metadata analysis, a Content Credentials (C2PA) check, image source search, and other available technical indicators. All results are probabilistic and informational only, as described in Section 3.

The credit cost of an analysis is shown at checkout and on the pricing page and may change over time. A single charge covers the full report; no separate purchase is required to access any part of it.

3. No Guarantee of Accuracy

PhotoProof Labs does not guarantee that any result, score, probability, report, or analysis is accurate, complete, or error-free.

The service may produce false positives and false negatives.

Results must not be treated as definitive proof of the origin, authenticity, authorship, ownership or legality of any image, video or text.

Authenticity scores, AI probability scores, deepfake scores, origin detection and metadata-based conclusions are automated probabilistic estimates.

The Service does not provide forensic, legal, regulatory, investigative or evidentiary determinations.

Shared reports are read-only summaries of the same probabilistic analysis and do not make the result more certain or legally conclusive.

AI image detection accuracy can vary depending on image quality, compression, resizing, and the specific generative model or editing method used.

4. No Legal, Professional, or Investigative Advice

PhotoProof Labs is provided for informational purposes only.

Users must not rely solely on PhotoProof Labs results when making legal, regulatory, employment, law-enforcement, compliance, financial, or business decisions.

5. User Responsibilities

• You have the right to upload and analyze the content you submit.
• You will not use the service for unlawful purposes.
• You will not attempt to interfere with, abuse, or disrupt the service.
• You are responsible for ensuring that you have the necessary rights and permissions to upload any image submitted for analysis.

6. Uploaded Images

You may submit only images, videos or text that you have the right and lawful basis to analyze.

Do not upload or paste content that violates privacy rights, intellectual property rights, confidentiality duties or applicable law.

Do not submit highly sensitive personal data unless you have a lawful basis and understand the risks of automated processing.

Video analysis is currently unavailable and marked as a future feature. Do not attempt to upload videos outside the supported interface.

Text analysis is not currently available and is not exposed through the product interface. Do not attempt to submit text for analysis outside the supported interface.

Temporary original image availability

To complete the analysis or source search, PhotoProof Labs may need to reuse the original image file. That original file is only retained for a limited period, as described in the Privacy Policy. If the retention period has passed or the file is otherwise no longer available, we do not guarantee that the analysis or source search can be completed, and you may be asked to re-upload the image.

Source Investigation results

Source Investigation uses a third-party reverse-image search provider to look for visually similar images published elsewhere. We do not guarantee the accuracy, completeness, availability or continued existence of any third-party search result, and a lack of matching results does not confirm that an image is original or has not been published elsewhere.

Shared reports

If you create a shared report link, you are responsible for ensuring that you have the right to share the image preview and report contents.

Shared links are read-only but public to anyone who has the link. Do not share sensitive, confidential or unlawful content.

Shared report links are currently set to expire approximately 30 days after creation or last re-share. Deleting the underlying report or your account ends access through that link even earlier. Once a shared link stops working, anyone who had the link loses access to that shared view.

Payments, credits and payment providers

PhotoProof Labs sells prepaid analysis credits. Credits are used only to obtain PhotoProof Labs analysis services, are not cash, stored value, bank deposits or transferable balances, and cannot normally be redeemed for cash.

Depending on the payment method you choose at checkout, your purchase may be processed by Paddle.com Market Limited ("Paddle") or by PayPal. For a transaction processed through Paddle, Paddle acts as the Merchant of Record (or authorized reseller) for that transaction, and Paddle's own buyer terms apply in addition to these Terms. For a transaction processed through PayPal, PayPal processes that payment through PayPal's own payment flow, and PayPal's payment terms apply in addition to these Terms. Paddle is not the Merchant of Record for PayPal transactions, and PayPal is not involved in transactions processed through Paddle. Credits are added to your account only after the applicable payment provider confirms successful payment.

Prices, packages and availability may change. Any applicable payment provider fees, taxes, card issuer fees or currency conversion costs are handled according to the applicable payment provider's own terms.

If payment verification fails or an order appears fraudulent, duplicated, cancelled or mismatched to your account, credits may not be added or may be reversed.

Refunds

Refunds for purchased credits, and the separate question of restoring a consumed analysis credit after a technical failure, are governed by our Refund Policy, together with the applicable payment provider's own terms and any mandatory consumer protection law.

7. Limitation of Liability

To the maximum extent permitted by law, PhotoProof Labs and its operators shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of the service or reliance on any analysis result.

Use of the service is entirely at your own risk.

8. Service Availability

We may modify, suspend, restrict, or discontinue the service at any time without prior notice.

We do not guarantee uninterrupted availability.

9. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the service after changes become effective constitutes acceptance of the revised terms.

10. Age Requirements

You must be at least 16 years old, or the minimum age required in your jurisdiction, to use PhotoProof Labs. If you are under the applicable age, you may only use the service with the involvement and consent of a parent or legal guardian.

11. Prohibited Uses

You may not use PhotoProof Labs for unlawful activities, harassment, discrimination, surveillance of individuals without lawful authority, or any activity that violates applicable laws.

You may not use PhotoProof Labs as the sole basis for legal, employment, law-enforcement, immigration, credit, insurance, or similarly significant decisions.

13. Account deletion

You may delete your account from the profile page. Account deletion permanently removes your account access and deletes account-linked reports, credits ledger records and public report links.

Deletion cannot be undone. You are responsible for exporting or copying any information you need before deleting your account.

Intellectual Property

The PhotoProof Labs name, logo, design, text, and images on this site are owned by PhotoProof Labs and protected by applicable copyright and trademark law.

Content you upload for analysis remains your property. We do not claim ownership of images, videos, or text you submit.

You may not reproduce, redistribute, or create derivative works from PhotoProof Labs's own content without prior written permission.
